A seller of modded Switch consoles agrees to pay Nintendo $2 million

Back in July 2024, Nintendo filed a lawsuit against Ryan Daly. The manufacturer accused him of selling modified Switch consoles in his Modded Hardware store in Michigan. He also sold components that allowed pirated Switch games to be played on unmodified consoles.

The retailer then announced that he would stop selling these machines. However, he reportedly continued to do so, and Nintendo filed a lawsuit with six counts, including "trafficking in circumvention devices" and copyright infringement. Daly denied these allegations, presenting evidence that could have exonerated him from any liability.

Ultimately, the two sides reached an agreement to avoid taking the case to court. Ryan Daly agreed to pay Nintendo $2 million to have the complaint dismissed. A permanent injunction will also prohibit the seller from marketing, handling, and promoting modified devices. He will also be prohibited from providing documentation or assistance to others to do so.

According to Nintendo, Daly also supplied pirated games to his customers.
